EHF Court of Arbitration decided about a compensation for HC Croatia Osiguranje Zagreb
ECA confirm the result of Zagreb vs Minsk match
The award of the EHF Court of Arbitration (ECA) regarding the claim filed by HC Croatia Osiguranje Zagreb has been released confirming the result (23:25) of their VELUX EHF Champions League match vs. HC Dinamo Minsk which took place on Saturday 9 February 2013. The decision of ECA is final.
The Croatian club filed a claim against the EHF Court of Appeal decision dated 21 February 2013 which upheld the first instance EHF Court of Handball rejection of the HC Croatia Osiguranje Zagreb´s protest. The content of the Zagreb´s protest refered to a situation in the first half of the match, where, according to Zagreb´s protest, a suspended player of Minsk entered the court while his suspension time was still going on.
The Arbitral chamber agreed with the EHF Court of Appeal on the fact that decisions taken by referees on the playing court, including those based on EHF delegates’ recommendations, are factual and shall be final. However, (pursuant to article 6.3 of the EHF Legal Regulations) the Arbitral chamber decided to make adjustments as the error in the present case was obvious and revealed by means of pertinent evidence.
Consequently, the Arbitral chamber (pursuant to article 14.1 and 12.4 of the EHF Legal Regulations), decided to award damage compensation to HC Croatia Osiguranje Zagreb to compensate their financial damage due to the loss of opportunity to qualify for the last 16 phase.
The disputes brought to the ECA are settled by an arbitral chamber composed of three arbitrators, part of the ECA list of arbitrators, following a specific procedure defined in the Rules of Arbitration for ECA. Further information can be found on the ECA.
